Clearance Sales And Consumer Protection

Summary/Abstract: It is a generally known fact that clearance sales are not a recent phenomenon in commerce. They used to be rare and occurred only when the shelf life of certain merchandise had expired or if a shop was closing down. They were “real” clearance sales and for the purpose of consumer protection the rules of how to organize a sale were clearly defined. This can be best illustrated by the fact that these sales and customer (consumer) rights used to be regulated in Serbia by a special law, the Law on Clearance Sales. In time, a new type of sale of seasonal clothes and footwear emerged, endorsed by commercial establishments, which viewed it as a justified sale of merchandise no longer in fashion and therefore sold at a lower price. However, in addition to the “real” sales, today there are also ostensible clearance sales which only serve to attract consumers. One of the reasons for the existence of ostensible clearance sales is the absence of clear regulations in this field. The damage is widespread and affects a number of subjects - the consumers who are misled and also the vendors due to unfair competition
