Summary/Abstract: Turbulent geopolitical processes and current threats of terrorism and migrantrefugee wave, increasingly lead to the application of state of emergency in many countries. It cannot be ruled out that under certain unfavorable developments this institute won't be implemented in our country. This article corresponds to the need for further research of the state of emergency, as clarified in large strokes some major legal and philosophical views and on this basis provides an assessment of current legislation and proposals, de lege ferenda, for its improvement.
