Summary/Abstract: At 1st October 2011 entered into force New Civil Code (NCC), repealing as it was normal, all provisions of old Civil Code. But in the content of New Civil Code were not included all institutions which were included in old code, the means of proof being left in the account of New Code of Civil Procedure (NCPC) in force from 15th february 2013. Thus, an important part of the proof’s institution, which til now was regulated by the old Civil Code, we retrieve, as it was normal, in the New Code of Civil Procedure, this being first new brought by NCPC. A new item is the enactment of proof meaning totally new, which were not retrieved neither in old Civil code, neither in Code of civil procedure. New means of proof appeared as a necessity justified by both the evolution of modern society and the civil trial itself.
