Summary/Abstract: The article brings analysis of one of the most famous decisions concerning class actions in the United States of America, Wall Mart v. Dukes. The key issue of the case was to decide whether the article 23 (b) of the Federal Rules of Civil Procedure can be applied. Among all, the relevant question was to determine what we still can consider as question of law or fact common to the class so the class action can be granted.
