Summary/Abstract: The free access of all citizens to public information and their participation in the decision making process are considered to be two of the most important premises of democratic and reliable governance. On the one hand, information enables citizens to assess the actions of the administration having full knowledge of the facts, and on the other hand, it allows them to participate in debates and in making decisions that concern them. Citizen participation in power is reflected by their right to information, as they are also entitled to get involved in the various forms of semi-direct democracy, which, in Romania, are regulated by different constitutional and legal regulations. Starting from the exposition of the constitution provisions regulating citizen participation in governance, an analysis was carried out of a series of legal requirements concerning the matter under debate, that is: Law no. 3/2000 of the organization and performance of the referendum, with later additions, Law no. 544/2001 on the free access to public information, Law no. 215/2001 on local government, with later additions and amendments, Law no. 52/2003 on decision making transparency in local government and Law no. 161/2003 on specific transparency measures required in the exercise of public office duties, public positions and in the business environment, for corruption prevention and control.
