The National Sovereignty in the Context of the Integration of States in the European Union

Summary/Abstract: The paper aims first at clarifying the notions of “state sovereignty”, “people’s sovereignty”, “national sovereignty”, “politico-economical sovereignty”. The notion of the sovereignty needs to be understood in the context of the new realities, both domestic – the strong tendency of decentralization as well as foreign – the integration of states in super national structures. The paper approaches national sovereignty in the conditions of the integration of states in the European Union. In the same light, the modifications of Romania’s Constitution in 2003 are also mentioned, modifications pertaining to the national sovereignty following Romania’s adhesion to the European Union. We conclude that the state sovereignty is not affected either by the European integration or by the institutionalization of regionalism. Both processes require a certain transfer of state power, but the purpose of the transfers resides in the fulfilment of public duties which, in the context of globalisation, the state can no longer accomplish by itself. Thus, the general role of the state needs to be reconsidered.
