Summary/Abstract: Law on Cultural Assets, which regulates the archival material and activity in the Republic of Serbia, increasingly manifests its drawbacks when it comes to the complex area of archival operations. Its provisions have a more general character and can not be applied in any specific cases that the practice is showing before us. Archival service seeks ways and means to solve many unclear issues in the profession and expertise.In the process of performing public duties, archives act upon administrative rules. Law on Administrative Procedure applies when there is no special law for the particular legal area. It is evident that the specific archival tasks require passing a special law that would specifically regulate mentioned issues. The interweaving of the tasks performed by the archive, the kind of jobs that are closer to the culture and administration, science and publishers, requires that they are given special attention, and this will be the best when its framed by a law regulating the matter of their work. Until then, archivists set tasks that will need to be solved in accordance with their professionalism and conscientiousness in the current (lack of) legal solutions.
