Summary/Abstract: The issue of preservation and protection of archival records that is in private ownership is a major problem archive of countries emerging from the former socialist bloc. One of the most important conditions for quality protection - legal regulations, in almost everywhere arrived with delays. This paper briefly treated the question of existence and protection of private archives and archival material, which in the Republic of Serbia has yet to “legitimize” after making the early implementation of the new law on archives, with reference to the legislation of other ex-Yu republics, the question of accommodation in private archive , and some experience of the Historical Archives of the City of Novi Sad on this issue.
