Summary/Abstract: On the basis of the Treaty of Nice, the European Union institution shave obtained a crucial right to inspection rule of law in its Member States, encompassing the areas of law being within their exclusive competence.The main aim of the study is to analyze the legitimacy of this extensive intrusion European Union in particular from the point of view of the objectivesof this organization. The author indicates that the area in which the European Union has a real interest are the elections to the nationalauthorities that participate in the European Union legislative procedure. Election of this authorities in undemocratic procedure weakens – already under mined – legitimacy of the European Union. The author postulates the reby limiting the scope of this control.
