Summary/Abstract: The free access into justice is a general principle of law, indissoluble bounded to democracy. The State of Law of the governing form of democracy has the obligation to adopt the right procedures to facilitate more and more this access to right. If at the national level we have an adequate legislation, corresponding to the European level, the Romanian legislator helped by the Legislative Council, pursuant to the Section 79 of the Constitution, has to create clear and coherent procedures of access to the Court of Justice of the European Community.
