Summary/Abstract: The present study had at its origin the ununiform forensic practice in civil area, but penal also, and especially the solution pronounced in a civil litigation regarding the extraordinary method for attacking the defeasance litigation, the legal ideas that may occur from this, reported to the actual practical problems, we consider that worth to be analyzed.
