Summary/Abstract: The national lawmaker never was, and probably never will be, an innovator in the field of Civil law. This represents a pure and indisputable given, not a reproche. Sincerely speaking, neither the 1864 lawmaker, nor the modern one were and are original authors. However, to be aware of a certain value, to cherish it, to relate to it, represents - per se - a conduct assumed with maturity and wisdom. This is why, in the field of law, even to copy ad litteram the creation of other authors cannot be considered, basically, a reprehensible act.
