CONSIDERATIONS REGARDING THE NOTION OF URGENCY IN THE MATER OF PRESIDENTIAL ORDINANCE

Summary/Abstract: According to the distinguished author Serge Guinchard, the civil procedure represents: the terrible child of the legal family. An extremely complex matter with a pronounced technical, almost mathematical nature, which, in a special way, approaches it rather to natural sciences, it gives to any study – by the characteristics underlined – a distant, glacial note. Nevertheless, a discovery of a theme of a fine suppleness, allowing luxuriant nuances, with an impressive chromatic range, it represented a true „feast” for us”. On the one hand, in terms of the possibility of issuing new theories, original in our opinion, as well as worthy of being developed, as well as combated, and on the other hand, in terms of the attempt – a fight with ourselves – to express any idea by an authentic poetry of the legal language.
