Summary/Abstract: The paper concerns one of the defects of the matrimonial consent. Firstly, the author analyzes the genesis of a condition. Secondly, he discusses the evolution of the norms on that manner, beginning with the ius vetus, through the 1917 Code, schemes developed during the work on the revision of the Code, to the norms on the conditional consent presented in the new Code of 1983. Moreover, he presents the most recent trends in the canonistics aiming at the development of the term: «implicitly stated condition».
