Opinion on enforcing the provisions of article 83 of the Criminal Code and article 85 of the Criminal Code in case of simultaneity

Summary/Abstract: Upon finding from the case file that the defendant has been previously sentenced by means of two or more final criminal sentences to imprisonment for concurrent crimes, the executions of which have been conditionally suspended, on the grounds of article 81 of the Criminal Code, and the crime which forms the object matter of the trial has been committed during the probation for each of the crimes for which the defendant has already been sentenced, the First Instance Court shall always enforce the provisions of article 85 of the Criminal Code, and shall cancel the conditional remission of the sentence for each previous crime.
