Summary/Abstract: The author is of the opinion that the period of economic recovery and record low unemployment in Czech Republic should be used to make fundamental changes in the liberalization of the Czech Labor Code and the latest government’s draft amendments to the Labor Code considers as insufficient and criticizes efforts to revise the recent decision by the Constitutional Court in the area of Collective Labor Law. In comparison the author describes recent efforts to overcome the decision Abood vs. Detroit Board of Education and the effect of incomplete staffing in the US Supreme Court on decision in this case.
