Summary/Abstract: This article makes a short presentation and analysis of the recent case law of the High Court of Cassation and Justice in the matter of applying and interpreting the Law No. 221/2009 and of the Law No. 33/1994. The analysis of the solutions delivered by the High Court of Cassation and Justice in the matter of the Law No. 33/1994 is extremely important because prosecutors participate in such cases, the purpose being to formulate legal conclusions and to unify the practice of courts.
