Taking the measure of declaring as undesirable of a foreigner, according to art. 86 from the Government Emergency Ordinance no. 194/2002 regarding the foreigner’s regime in Romania, republished, for reasons of national security

Summary/Abstract: The courts, in the situation in which they have decided to take the measure as undesirable, pursuant to art. 86 of the Government Emergency Ordinance no. 194/2002 regarding the regime of foreigners in Romania, republished, for reasons of national security of foreign citizens, as well as the return of persons declared as undesirable, shall comply with the provisions of art. 2, art. 3 and art. 8 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, but also the provisions of art. 1 of Protocol no. 7 additional to this Convention. Under all circumstances, they will order the return of foreign citizens only in those states where life is not jeopardized.
