Summary/Abstract: This first part of a larger article describes the reactions, documented over a period of several months – November 2014 – March 2015 –, elicited by Decision 669/2014 of the Constitutional Court. I highlighted, on one hand, the manner in which the rights of children to equality in front of the law and freedom of thought, conscience and religion, in its interaction with the right to education, are negotiated between the Romanian Orthodox Church and fundamentalist religious organization, and the Ministry of Education and Research, in violation of the superior interest of the child. I also documented the efforts of NGOs fighting for the separation between Church and State, as an essential condition for the promotion of the rights of the child within public schools. The confrontation between the actors mentioned above, begun long before the start of this study, highlights the evolution of the regulations and the jurisprudence of district courts and the Constitutional Court in this area, i.e. the separation of Church and State, in particular in the case of religious education in public schools.
