Summary/Abstract: The use of technicalsurveillance in criminal proceedingsrefers to interception of communicationsor any kind of remote communications,access to a informatics system, audiovideosurveillance, tracking and locatingby technical means and obtaining data ona person's financial transactions. The useof technical surveillance binds thecriminal investigation body to fulfill allthe necessary conditions stipulated by thelaw, such as proportionality andsubsidiarity principles, an on-goinginvestigation regarding an offensestipulated in art. 139 par. 2 of theCriminal Procedure Code. The judicialbodies must always consider the balancethat must exist between the achievementof a criminal investigation and the respectfor right to privacy, family, private andpostal secrecy.
