Summary/Abstract: In this situation in BiH, where every archive has its own law, and the great changes occur in the state, particularly when it is about the proprietary relations, the necessity imposes to define more comprehensively and more precise the relations towards registrar and archival materials. The present situation is such that there is less and less public property. We are in the middle of privatization; therefore we have various forms of the ownership: from private, over semi-private, to the situation that some foreign physical or juristic person is the owner of the firm or the institution that creates active records and archival materials. The archival legislation should clearly define the forms of the ownership over the archival materials. Also, a clear definition should be made whether the private archives can be created beside the public ones; more precisely: who and in which way has the right and what are the obligations regarding collecting, documenting, protecting, preserving and presenting the archival materials.
