LEGAL CONSIDERATIONS ON MEDICAL PROFESSIONAL SECRECY, BETWEEN THE OBLIGATION TO KEEP THE SECRET AND OBLIGATION TO DISCLOSE THIS

Summary/Abstract: To keep professional secrecy is an obligation that can be found in many legal systems and the medical field is one of the oldest that was introduced this obligation. Modern society, cutting-edge medical technologies, means of communication and other such elements have also generated new problems not only in strictly medical area and especially in the field of medical ethics, but also in the law. This article proposes an insight into the issues relating to Romanian legislation about medical professional secrecy, with forays into the legislation of other countries, and notes the need for legal debate and potential legislative changes on both of unwarranted extension of the obligation of keeping medical secrecy and of the need to establish more clearly where the doctor has the right or is required to disclose confidential information.
