Summary/Abstract: Transnational posting of workers within the European Union is a way for the employer to change the place of work of a worker from one Member State to another Member State for a limited period of time. This form of posting of workers has effects not only at the personal level, for the posted worker or the posting employer, but also at the state level, with a multitude of legal, economic and social consequences. The posting of workers has been regulated at European Union level for more than 20 years by Directive 96/71/EC, and there is currently a debate on a draft amendment to this directive which divided the European states into two parts: the first part composed of the Eastern European states, the poorer ones, and the second part containing the richer Western European states. The recent events on the European political scene as well as the statements of European leaders showing confusion and the lack of knowledge of the correct and complete meaning of some notions of the posting of workers led us to try to clarify through this article.
