Summary/Abstract: In the first part of this work historical and conceptual conditions important for the phenomenon of refugees have been analyzed. The Peace of Westphalia of 1648, identified refugees as people who had lost the protection of their native and because of this, they are guaranteed the ius emigrandi. An actual framework shows that the phenomenon of refugees as a marginalized category is one of the main indicators of critical issue related to the social and statal structures, such as sovereignity and borders. In the second part, the theoretical one, our aim is to analyze a Hannah Arendt’s and Giorgio Agamben’s discourse related to the question of refugees. Arendts clearly affirms that the refugees are the product of inherent limit of State-nation, while, Agamben puts them in the context of naked life.
