Effects of behavior of a person taking invalid legal action

Summary/Abstract: The issue of invalidity sanction in civil law is now widely discussed. The literature recognizes the need for its liberalization (rational use) and even derogation from the annulment in favor of another form of interference in the content of legal action. For this reason, it seems important to look at the consequences of the invali- dity of legal action in a broader aspect. The invalidity sanction disable any legal consequences. In this context it is important to consider the further consequences of entities - who realize invalid legal action - behavior (restitution, compensation claims, the effects of tax consequences).
