Servicing companies according to the Law on Special Purpose Companies

Summary/Abstract: The main topic of the article is relations between Special purpose investment companies (SPIC) and servicing companies that can be defined as theirs obligatory partners. The study focuses on the question what criteria should satisfied these companies to be declared as servicing companies and especially to the problem should SPICs themselves to determine which companies are servicing and which are not. It has been proposed additional criteria that may be prescribed by the law establishing a company as a servicing. In that regard is made an attempt to define their duties and it is emphasized the problem whether they may have managerial functions or not. The conclusion is that, although servicing companies can help management of SPVs they are only servicing, rather than management companies.
