Summary/Abstract: This study is an attempt to present some ideas on plagiarism, hoping they will act as the required prerequisites to deepen them in the research on intellectual property law. The work rules both against the sentence pleading in favour of the solution that all intellectual creations should be absolute novelty, and against the tendency to give way to copying the ideas of others, without any personal contribution. In the author’s conception, the first sentence would lean towards zero the creation diagram of spiritual works, while the second would inevitably lead to the extinction of the creative spirit, to the quashing of inspiration, vocation and originality. The author believes that the solution of sanctioning plagiarism with mild exigency would be most beneficial as it offers the possibility for works of the spirit to emerge through creative effort, talent, creative capacity and respect for previous creations.
