Reflections about an Article 300 of the Labour Code

Summary/Abstract: Although the Labour code has been in force for 40 years, the discussion about article number 300 is still actual. One of the most interesting aspects of the subject mentioned is the meaning of labour law principles. Assuming they are second degree regulations, the fundamental task is to determine the rank of legal acts, which first degree regulations can be derived from. It is questionable to state that decrees or staff regulations can be the basis of their construction. There are also many doubts concerning the use of article 300 Labour code in collective labour law, although arguments used to support this thesis are interesting.
