The decision on building and land development conditions and extraordinary procedure - selected problems

Summary/Abstract: This article presents an analysis of the procedural regulation of invalidating of decision on the example of decision on building and land development conditions. For this purpose, the regulation of invalidating has been presented. The legislator distinguishes two types of decisions on building and land development: 1) decision on the location of investment of public purposes, 2) decision on building conditions. The study pointed out the problems encountered in practice concerning: a public purpose - in decisions on the location of investment of public purposes and the principle of good neighborliness - in decisions on building conditions. This is an issue important for this reason that the effects of the annulment of the decision on building and land development conditions are far-reaching. At the same time they must be considered in two aspects, first of all - claims for damages, and secondly - in the framework of the consequences for the validity of other act - a building permit.
