Legal Nature of Maritime Hypothecation

Summary/Abstract: According to the Polish Maritime Code, maritime hypothecation is alien mutatis mutandis governed by the provisions of civil law applicable to the hypothecation. Many authors criticize this definition and propose to define maritime hypothecation as a separate limited real right. The Author of the article is of the opinion that maritime hypothecation should be defined as a kind of hypothecation mutatis mutandis governed by the provisions of civil law applicable to the hypothecation.
