Social Dialogue in the Social Market Economy

Summary/Abstract: The social dialogue is an element of the social market economy. As it is a constitutional principle, the forms, scope and object of the social dialogue should be developed and regulated by statutory law. This also applies to the scope of entities authorized to conductthe dialogue. Meanwhile, the long-time neglect of that issue caused that this regulation was inconsistent and even fragmented - separate for EU projects, separate at regional andlocal levels and finally separate when it came to the delegation of public tasks to the so called third sector. Nevertheless, the increasingly common practice has allowed to formulate general principles of the social dialogue, the observance of which can make it aneffective instrument of the implementation of the social market economy. The principles are non-binding and they are elaborated by the interested parties themselves. However, the recognition of the canon of principles of the social dialogue in the universally binding legal act would accelerate the determination of the social dialogue at all levels of public administration.
