Summary/Abstract: The social market economy provides public authorities with the legal legitimacy to take measures in order to implement economic objectives with reference to uneconomic values such as solidarity and social justice. The adoption of the economic system based on the social market economy results in the necessity to take actions for the development and coherence as well as to take responsibility for social and economic relations by public authorities (the actors of development policy). The state is particularly obliged to take into account constitutional values and maintain the necessary balance between them. The advantageof some values over others or the “competitiveness” in the acts of development policy which refer to legislative actions should have a well-established axiological justification.
