Summary/Abstract: Valtazar Bogišić became famous by studying the legal customs and custom law and everything he achieved in this field proved to be of importance for global science. In this article the author examines his study of unwritten law which was preserved by people and which was still applied during Bogišić's life. The author believes that Valtazar Bogišić initially examined the legal customs of all Slavs and later those of south Slavs as a particular expression of national life which preserved as a relic from previous times. These customs, which were common for all south Slavs (and some of them for all Slavs), he understood as a particular national characteristic. The national spirit, psychological national characteristics, historical and ethnic origin - according to the historical and evolutionary legal school - all this may be understood as a factor which influenced the creation and preservation of legal customs. Bogišić, through supporting this school of thought, started his research of legal customs which were practiced by the people. The results that he achieved in this research of national law and legal customs of south Slavs are of invaluable scientific importance, both today and in the future.
