Between Scylla and Charybdis. The situation of the vessel of a European Union member state

Summary/Abstract: The legislative activity of the European Union in the field of maritime affairs has been growing steadily for several years and creating a coherent and comprehensive system. A significant part of this legislation reflects international standards. However, some noticeable differences in the implementation of these international standards to the European Union law, mainly the regulations of the International Maritime Organization, can be noticed in recent years. This results in the lack of uniformity concerning the requirements for vessels registered in one of EU member states and vessels registered in third countries, which is undesirable both for EU member states and the international community. The article is an attempt to re-evaluate such legal status, both from the perspective of the interests of sea protection and the situation of the owners of vessels in EU member states. The starting point is the opinion representing the dogma in the doctrine of the law of the sea and maritime law, according to which marine issues should be regulated on a global scale because the regionalization of these regimes can bring more harm than good.
