THE COMMUNICATION ENVIRONMENT AS GENERAL SAFETY - FROM THE PROTECTION REGULATION

Summary/Abstract: The article analyzes the communication environment, understood as part of the public sphere, which implements the right to communicate as a basic human right. The thesis is that the communication environment is one of the commons, along with soil, water, air, sunlight, broadcasting, language, culture. Commons are such natural and cultural resources that belong to all members of a society and of all human subjects and are vital to their existence. These are objects, spaces or areas whose nature and functions are essential for the survival and prosperity of all who inhabit a territory. From sharing these commons and unhindered access to them depends the satisfaction of basic human needs. According to the words of David Boliar „commons resources are not resources by themselves. They are resources plus community and social values, rules and norms, which it uses to manage resources.”. Commons should not be confused with open access mode, in which everyone has the right to take advantage of common resources as it sees fit. Commons require joint and responsible use and storage, as well as their protection from degradation or depletion so that it can be used in the same way the next generations. In this context, the communication medium can be defined as a common good, formed by the joint efforts of multiple actors, which include a variety of components by nature (physical infrastructure, technology and innovation models, information, ideas and knowledge). Communication environment is a complex and self-developing network of social relations, which implements the right to communicate as a basic human right. Communication environment considered as a common good can not be the subject of ownership. The focus in this case should be placed on its protection and preservation, including through the use of authority and the institutional power of public authority.
