COMPLIANCE WITH THE PENALTIES LIFE CLOSURE WITH ART. 3 OF THE EUROPEAN CONVENTION ON HUMAN RIGHTS

Summary/Abstract: The article discusses the existing law on life imprisonment without the possibility of parole, the prison regime for those serving life without parole and the chances for a change of this type of punishment by the power of pardon. The regulatory framework was examined in consideration of the newly set standards of the European Court of Human Rights in compliance with Art 3 of the Convention (see the judgment Vinter and Others v. The United Kingdom, 9 july 2013). In this regard, the judgment of the Court on the case Harakchiev and Tolumov against Bulgaria recommends reforms of the existing law and legal practices which are currently in violation with the European Convention on Human Rights
