Summary/Abstract: This article proposes a comprehensive analysis taking into account both the general rules and particular problems that arose in the doctrine and case-law on the resolution of partition actions. The analysis is interdisciplinary, with reference to the Civil Procedure Code of 1865 and the practice of the Constitutional Court.
