Summary/Abstract: The article is a broad analysis of the current regulation, framed by the analysis of the physiognomy of the petition for inheritance in roman law and the review of the definitions given in the French doctrine, with the associated nuances discovered by the authors in trying to conceptualize the right of the person claiming to be a true heir to act against a person who, by claiming their own inheritance rights, is in control, either in full or in part, of the inheritance assets.
