Summary/Abstract: In this study the author analyses the important role played by Law in the electoral process in Romania during the electoral law in 1926. The documents we based upon are mainly unpublished till now; they belong to the Ministry of Law fund. Starting with the important role played by Law during the electoral campaign and elections, the rulling party tried to exert some pressure against the magistrates, with a view to win the elections. The governmental pressure exerted on the magistrates was done either by obstructing the oposition, or by determining them to make electoral propaganda for govern. The governmental pressure exerted on the magistrates during local parliamentary elections was constant in inter-war Romania. The transfer and the dismissal of uncomfortable magistrates was an abuse of the government, during a time when the Constitution guaranteed the magistrates’irremovability and stability. It would be an exagerate thing to say that Law in all transformed itself in a mechanism to support the government during the elections. Generally, there were many cases when magistrates discharged their duty correctly and also many cases when they favorised the opposition during the elections. The fact that archives offer us more proves about encroachments of law than about the honesty of magistrates is explained by the absence of notes about positive, correct deeds. There are no documents about these; but, the complaints that created investigations were kept in archives.
