The powers of the tutor over the amounts of money from the protected individual’s accounts

Summary/Abstract: In banking practice, several issues have raised about the powers of the tutor over the amounts of money on accounts opened at a credit institution, on the name of the person under tutelage, either minor, either under judicial disability. The article contains an analysis of art. 149 par. (1) and (2) of the Civil Code, but there are also discussed some special situations appeared in the banking practice or on bank’s responsibility in the case of not respecting the conditions in which the tutor may dispose of the amounts of money from the account.
