Fine calibration of the competition law sanction

Summary/Abstract: Competition law entails multi-directional action, as administrative, criminal and civil law. Hence, the measures taken under competition legislation have different scopes, in accordance with the applicable law filed: preventive, punitive, enabling remedy and other specific functions, such as the market regulatory function. The legal instruments the authorities have at disposition in order to serve these functions raise the question whether same functions are well served by the measures pertaining to competition law infringements.
