Summary/Abstract: The contractual negotiation, an intrinsec stage of the formation of a contract, may be defined, lato sensu, as the process of obtaining what we want from someone who wants something in return from us. The negotiation implies, on one hand, the existence of some initial convergence points, beyond one's original position, valued by the parties during the process and on the other hand, it implies the communication by all means available. The essence of the negotiation is represented by the harmonisation of divergent interests by the common search for mutual advantageous solutions.
