Novum in criminal proceedings - Complaints against the judgment of the court of appeal in the amended Criminal Procedure Code

Summary/Abstract: This article presents a discussion of the new remedy in the criminal process introduced under amendments to the Criminal Procedure Code in March 2016. Its main objective was to reduce the adversarial process. Action against the judgment of the appellate court is entitled to the judgment of the court of second instance repealing the judgment of the court of first instance and remanded the case for reconsideration. According to the legislator to adjudicate kasatoryjne in the criminal process is being abused, so that it is necessary to create a measure to cause more frequent substantive adjudication and thus speed up the process.
