Summary/Abstract: It is for sure that, with every occasion that a human action is regulated, for the first time, in the CriminalCode, it is difficult to avoid all problems that may appear. Furthermore, the task to protect, by criminal means, a socialvalue as complex as the private life of a person does not make it any easier. However, the article 226 of the RomanianCriminal Code, given the way that it is regulated (and taking into account the terms that are used), will determine theapparence of a serie of problemes in the judicial practice, difficult, if not imposible to solve.
