Summary/Abstract: The article deals with issues of boundaries between cosmetic services and medical services. Its purpose is to identify the appropriate legal qualification and performance basis for cosmetic services. The studies covered the concepts of cosmetic services, cosmetology and aesthetic medicine as well as the qualifications of those who performed them. The last part was devoted to the legal qualification of the contract for cosmetic services and cosmetology services contracts. The studies indicated the heterogeneity of the two agreements. There is no legal regulation for a cosmetic contract. This causes a danger to the users. The types of treatments offered on the market make the cosmetic service little different from health care. Therefore, it is necessary to establish the boundary between medical activities and cosmetic services. Analysis of the characteristics of the contract for cosmetic services and the mixed nature of these contracts indicate that their qualification should be based on Art. 750 k.c. This provision should apply to cosmetic services not covered by other provisions. It provides a better basis for possible claims to a beautician.
