Summary/Abstract: To mention in the further appeal’s content the identification data of the lawyer through which it is filed is not an admissibility condition of the appeal. The defendant can file a further appeal both against the conviction ruled in the appeal and in the first instance, maintained in the appeal. By “fulfilling improperly the act”, commissive material element of the maladministration offence, we mean the violation of a duty that the agent is obliged to accomplish under his job activities, duty provided by a law, a government ordinance or an emergency government ordinance.
