Summary/Abstract: Trafficking in human beings is itself an essential violation of an individual rights and freedoms, and in the migration context this crime is more serious because the victims do not have many options and are easier to cheat. Traffickers take advantage of the lack of documents and financial resources of the migrants and lure them with well-built stories by which they promise them all kinds of jobs or conditions to rebuild their lives to a better standard of living and help in their integration into the new state. Thus, migrants are being exploited and treated as slaves without receiving what was promised them. Many times is made confusion between trafficking in human beings having as victims the migrants and the trafficking of migrants, these being two distinct crimes. If for the migrants trafficking there is a previous agreement between the trafficker and the migrant, and they know the terms and the risks they are subject to when they accept to cross illegally the border of a state, for the human beings trafficking they are misled because they are presented with facts that are not real.
