Successional reserve and forced heirs in regulating the new Civil Code

Summary/Abstract: The study hereby aims to analyze the position that certain categories of heirs of the deceased, namely forced heirs acquire under the new regulation of the Civil Code. The analysis is based on presentation of the current status of forced heirs, in the framework of the current Civil Code and Decree-Law no. 319/1944 and continues with the presentation of the position of these categories of heirs under the new Civil Code.There are called forth changes occurred between the current and future legislation, and, most importantly, there is strongly emphasized strengthening of the position of surviving spouse as forced heir against the other heirs of the deceased.
