Summary/Abstract: The emergence of the human rights at the end of the 18th century lead not only to the forging of the modern concept of citizen, but also to the intrinsic tension between the character, declared universal, and its legitimacy, limited initially only to some occidental countries. The almost natural tendency of extending of the jurisdiction of these rights coincided with the internationalization process of the modern civilization and, thus, with the meeting and, sometimes, with its conflict with other premodern civilizations. The author analyses the ambiguities and, especially, the theoretical and practical confusions that the modern concept of right may give raise to in such complex context, outlining the effects that the jurisdiction of the modern rights has upon the redefinition of the person and of the territory.
