Summary/Abstract: The integration process in the European Union of the former communist countries deals not only with material and quantitative difficulties – lower level of economical and technological development than the western countries for example – but also with qualitative and structural difficulties. The acculturation communism favored – including cutting roots binding it by the previous historic ages – along with the repressive regime after the second World War in those countries – which is own to the dictatorship of the proletariat – made the exception state become a mental, political and juridical phenomenon within which the exceptionality itself – in both meanings: positive and negative – had been a perpetual provocation for scholars. The author tries to follow the non-authentic, exceptional meaning of the exception both in the field politics, at national and international level and in the field of law, generally speaking, characteristic to the human rights by examining the status of the minorities in this region.
